These Terms of Service ("Terms") govern your access to and use of the ParcelGala mobile application, web administration console and related services (the "Service"), provided by Paygala Limited ("Paygala", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
ParcelGala is a parcel and cargo management platform that enables courier companies and their authorized staff to register, track, dispatch, offload and hand over parcels, print receipts and manifests, send customer notifications, and view operational reports.
2. Accounts and eligibility
- Accounts are created for staff by a company administrator or by Paygala. You must be authorized by your company to use the Service.
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- You must provide accurate information and keep it up to date.
- Notify us promptly of any unauthorized use or security breach.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent or unauthorized purpose.
- Enter false, misleading or other people's personal data without authority or a lawful basis.
- Attempt to access data or accounts you are not authorized to access.
- Interfere with, disrupt, reverse engineer, or attempt to gain unauthorized access to the Service or its systems.
- Use the Service to send unlawful, abusive or unsolicited communications.
4. Company and customer data
Courier companies are responsible for the operational and customer data they enter (including sender and recipient details) and for ensuring they have the right to provide it and to send parcel-related SMS notifications. Paygala processes such data in accordance with our Privacy Policy.
5. Intellectual property
The Service, including its software, design, text and trademarks ("ParcelGala", "Paygala"), is owned by Paygala Limited and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your company's internal business purposes. You may not copy, modify, distribute, sell or lease any part of the Service.
6. Service availability and changes
We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may update, suspend or discontinue features at any time. We may also perform maintenance that temporarily limits availability.
7. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will meet your requirements or be error-free.
8. Limitation of liability
To the maximum extent permitted by law, Paygala and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service is limited to the amounts paid (if any) for the Service in the twelve months preceding the claim.
9. Termination
We may suspend or terminate access to the Service if you violate these Terms or if directed by your company. You or your company may stop using the Service and request account deletion at any time (see Account & Data Deletion). Provisions that by their nature should survive termination will survive.
10. Governing law
These Terms are governed by the laws of the United Republic of Tanzania, without regard to its conflict-of-laws rules. Courts located in Tanzania will have jurisdiction over any disputes, subject to any mandatory rights you may have under applicable law.
11. Changes to these Terms
We may revise these Terms from time to time. We will update the "Last updated" date above and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
