These Terms of Service ("Terms") govern your use of the Shazi mobile application and marketplace ("the App") operated by PayGala Limited ("we", "us"). By creating an account or using the App — as a customer, restaurant partner or driver — you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
- You must be at least 18 years old to create an account.
- Drivers must hold a valid driving licence and any permits required by law, and provide accurate vehicle and identity documents.
- Restaurant partners must provide accurate business, licensing and menu information.
- You are responsible for keeping your login credentials confidential and for all activity on your account.
2. The service
Shazi is a marketplace that lets customers order food from participating restaurants for delivery by independent drivers. We facilitate the connection, payment and delivery tracking between customers, restaurants and drivers, but we do not prepare food ourselves.
3. Orders & payment
- Placing an order is an offer to purchase, which is accepted once the restaurant confirms it. Prices, delivery fees and estimated delivery times shown in the App may change and are not guaranteed.
- Payment is collected at checkout via mobile money, card, or cash on delivery where available, through our payment partner.
- We may charge a service or delivery fee, disclosed before you confirm your order.
4. Cancellations & refunds
Orders may be cancelled before a restaurant begins preparation; once preparation has started, cancellation may not be possible or may be subject to a fee. Refunds for incorrect, missing or undelivered items are reviewed case-by-case and, where approved, issued to your original payment method or as App credit.
5. Restaurant partners
Restaurant partners are independent businesses responsible for the quality, safety, pricing and accuracy of the food and menu information they list. Shazi is not responsible for food quality, allergens, or preparation, but will assist in resolving order issues raised through the App.
6. Drivers
Drivers are independent contractors, not employees of Shazi. Drivers must deliver orders promptly, handle food safely, and follow applicable traffic and safety laws. Shazi may suspend a driver's access for safety complaints, fraud, or repeated late or failed deliveries.
7. Acceptable use
You agree not to use the App for any unlawful purpose, to provide false information, to impersonate another person, to attempt to gain unauthorised access, or to interfere with the App's operation, ratings, or security.
8. Ratings & reviews
Customers, restaurants and drivers may rate and review each other after an order. Reviews must be honest and must not contain abusive, defamatory or unlawful content. We may remove reviews that breach these Terms.
9. Notifications
By using the App you agree to receive transactional and service messages — including order confirmations, delivery status and promotions you have not opted out of — by push notification, in-app message, SMS or email.
10. Intellectual property
The App, its content, logos and software are owned by us or our licensors and are protected by law. You are granted a limited, non-exclusive, non-transferable licence to use the App for its intended purpose.
11. Disclaimers & limitation of liability
The App is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for delays, food quality issues, or service interruptions caused by restaurants, drivers, or factors outside our reasonable control.
12. Suspension & termination
We may suspend or close your account if you breach these Terms, provide false information, or where required by law. You may stop using the App at any time; any amount already owed remains payable.
13. Governing law
These Terms are governed by the laws of the United Republic of Tanzania. Disputes are subject to the jurisdiction of the courts of Tanzania.
14. Changes to these Terms
We may update these Terms from time to time. The "Effective date" above shows the latest version, and significant changes will be communicated in the App. Continued use after an update means you accept the revised Terms.
